BRESBET TERMS AND CONDITIONS These Terms are the terms on which the bresbet.com website (which is owned, operated and managed by BresBet Ltd), the products and your account are made available to the customer (you), by BresBet (we/us/our). The Terms are a legally binding agreement, and you should read them carefully. By using the BresBet website, the products and/or opening an account, you indicate your acceptance of these Terms. If you do not agree to any of the provisions of these Terms, you should immediately stop using the BresBet website, the products and your account. Accounts are only available to people over 18 years old (underage gambling is an offence) Anyone under the age of 18 is prohibited from placing bets and we will void any transactions they make. We carry out age verification checks in line with our Privacy Policy by using external agencies and by requesting supporting documentation if necessary. No betting activity may be carried out by a person who has not complete our age verification process. Where an account has been opened by a person aged under 18 years old, we will close the account and may void any gambling activity on that account. 9. By accepting the T&Cs and/or registering to use the website you agree that we’re entitled to conduct any identification, credit and other verification checks from time to time that may be required and/or are required by applicable laws and regulations and/or by the relevant regulatory authorities for use of the website and our products generally. You agree to provide all such information as we require in connection with such verification checks. We’ll be entitled to suspend or restrict your account in any manner that we may deem to be appropriate until the relevant checks are completed to our satisfaction. 10. If, during our Know Your Customer (KYC) verification process, we’re unable to verify your details, you’re unable and/or unwilling to provide documentation or other information requested, your account will be suspended and we’ll within a reasonable time: return any residual balance, up to the value of your initial deposits, at the time of the unsuccessful verification, however, any winnings will not be credited. 11. As part of the registration process, and during the lifetime of your account, we supply your personal information to authorised credit reference agencies to confirm your identity and to make regulatory checks in relation to financial vulnerability. This is in accordance with our regulatory obligations. You agree that we can process such information in connection with your account. 12. You can only open one account with us. Should we identify that you’ve got more than one account, and we deem you to have circumvented our controls or regulatory obligations, we reserve the right to close any such accounts immediately and without prior notice. If this happens, we’ll void all bonuses, free bets and winnings accrued using the additional account. These will be forfeited by you, and we’ll return any residual balance back to the payment method used to deposit the funds in the first instance. You can only register an account in your own name, solely for your own personal use, entertainment and benefit, not on behalf of or at the direction of anyone else. 13. Acceptable documentation to complete your account verification includes the following: Proof of identity – either a copy of your passport, driving licence or national identity card (these need to be in date) Proof of address - a recent utility bill or a bank statement less than three (3) months old Proof of payment – subject to the deposit method used (a copy of the front and back of the card used or bank statement showing your personal details and transactions to us; for ‘virtual’ cards we require a copy of the online bank statement showing transactions with us and a screenshot of the virtual card details) Additional verification may be required such as proof of funds or source of wealth We require downloaded documents in relation to bank account proof and may not be able to accept screenshots. If we believe you have provided fraudulent or tampered documents in an attempt to bypass any part of our process, we reserve the right to close your account. 14. It’s also your responsibility to ensure that any card issuer allows the card to be used for gambling purposes. We can’t accept responsibility for any action taken by a card issuer against an account holder. 16. You’re responsible for all bets placed on your account where the correct password has been provided. So it’s important that you don’t share any of your account details with a third party, under any circumstances. If you believe that a third party might have your password or account details, you should change your password immediately. 17. We’ll comply with applicable data protection laws (including, in the UK, the Data Protection Act 2018) in respect of the personal information you supply to us. Your personal information is processed in accordance with our Privacy Policy. 18. If you want to close your account, please contact us. 19. We reserve the right to close, limit or suspend your account at any time. You may be notified of an account limitation or closure by us, except where we discover or suspect that you have engaged in a Prohibited Activity, in such cases we’ll limit or suspend your account without prior notice and your account will remain restricted / suspended until our investigation is completed. You agree to cooperate fully with any such investigation. Your funds can’t be accessed or withdrawn during this time and your balance will remain in your account until the matter is resolved. If our investigation concludes that you have been engaged in a Prohibited Activity, we’ll permanently close your account and withhold all or part of your balance. The following activities are considered as Prohibited Activities: You become bankrupt. You intentionally or inadvertently attempt to, or deliberately try to, circumvent our Responsible Gambling policies, and procedures, limits or restrictions; We consider that you have used the website in a fraudulent manner or for illegal and/or unlawful or improper purposes; We consider that you have used the website in an unfair manner, have deliberately cheated or taken unfair advantage of us or any of our customers including card counting or similar advantage gaining tactics; We believe that your account is being used for the benefit of a third party, or on behalf of the third party, or if you’re using our site other than for your own personal or recreational use; You provided incorrect, incomplete or misleading information during the registration or afterwards; You have “charged back” or cause a “charge-back” against us or denied any of the deposits that you made to your account; We believe that you have allowed or enabled someone else to use or access your account: We discover you have deliberately or fraudulently opened or are using one or more Duplicate Account/s; You have used any third-party external player assistance programs or software which are designed to provide an unfair advantage to customers including (without limitation) the use of artificial intelligence, automated players (bots) and/or player assistance software; We discover or have reason to believe that you are depositing money into your account which originates from criminal and/or other illegal activities; When we believe you have breached these T&Cs If we’re requested to do so by the police, any regulatory authority or court. 20. We reserve the right to inform relevant authorities, online service providers, credit card companies, electronic payment providers, banks or other financial institutions of your identity and of any suspected unlawful, fraudulent or improper activity, and you agree to cooperate fully with us to investigate any such activity. C) YOUR FINANCES 21. You may only bet/wager with the amount of cleared funds held in your account. If you want to place bets or participate in gaming, you must deposit funds into your account. Further details on how to deposit, withdraw and transfer funds can be found in the My Account section of the website. 22. By depositing funds into your account, you direct us, and we agree to hold them, along with any winnings, for the sole and specific purpose of using them: to place your sporting and gaming stakes; and settling any fees or charges that you might incur in connection with the use of our services. 23. We’ll be entitled to suspend or close your account if we reasonably consider, or have reason to believe, that you’re depositing funds without any intention to place sporting and/or gaming stakes. In such circumstances, we may also report this to the relevant authorities. 24. You can only open an account in your own name and deposit using a debit card in the same name. You mustn’t deposit with a business debit card or bank transfer from a business account even if you are the business owner. We will ask you for additional verification should there be discrepancies between the cardholder’s name and the name of the BresBet account holder. 25. The use of third-party payment methods is strictly prohibited. We reserve the right to close or suspend your account where a third-party payment method is utilised, and to void any wagers placed on your account that were funded by a third-party debit card or any other third-party payment method. 26. If you have not placed a bet using your account for a period of 365 days, your account will be deemed to be dormant. If your account is classed as dormant and there’s a credit balance on the account, we will inform you by the email thirty (30) days before your account is due to become dormant, offering you the option to withdraw the funds from your account balance. If you don’t respond and don’t request a withdrawal of your remaining balance, we will attempt to repay the funds to the last payment method used by you. In cases, when the withdrawal attempt is unsuccessful for any reason, we will notify you about it again. 27. If your account is dormant and its balance is zero (0), we may close your account at our sole discretion. 28. We’re required by our licence to inform customers about what happens to funds which we hold on account for you, and the extent to which funds are protected in the event of our insolvency. The Gambling Commission provides further information on our licence conditions detailing what we need to tell customers about their funds. 29. Customer funds are segregated and kept in accounts separate from our business accounts to make sure that there’s always sufficient funds available for customers to withdraw their balances. In the unlikely event of insolvency however, these funds would form part of the assets of the business. This meets the Gambling Commission’s requirements for the segregation of customer funds at the level: “Not Protected - Segregation of customer funds.” 30. Where possible, all withdrawals will be processed to the payment account from which the deposits were made. Withdrawal payments can only be made in the name of and to the registered BresBet account holder. 31. For most payment types, withdrawals can be processed by clicking 'Withdraw' on the My Account part of the website, subject to there being sufficient funds in your betting account. There’s no set maximum withdrawal amount per day but withdrawal requests for amounts greater than £5,000 (or currency equivalent) may require additional arrangements. 32. If we incur any charge-backs, reversals or other charges in respect of your account, we reserve the right to charge you for the relevant amounts incurred. 33. You’re responsible for reporting your winnings and losses to the tax and/or other authorities in your jurisdiction. 34. We may be required – under our regulatory obligations – to carry out further due diligence checks on your account prior to processing a withdrawal when a withdrawal is requested with no or minimal play. 35. If the value of a deposit is not played through in full before a withdrawal is requested, we reserve the right to make a charge to your account to cover all reasonable costs relating to both the deposit and withdrawal. If necessary, the value of the withdrawal requested may be reduced accordingly. D) YOUR BETS 36. All bets placed with us will be settled in accordance with our Betting Rules. 37. We reserve the right to decline all, or part, of any bet/wager requested at our sole and absolute discretion. All bets/wagers are placed at your own risk and discretion. 38. We only accept bets/wagers made online (including via a mobile device or downloadable applications on a mobile device). Bets/wagers are not accepted in any other form (post, email, fax, etc.) and where received will be invalid and void - win or lose. 39. Bets/wagers will not be valid if there are insufficient funds in your account. 40. A bet/wager that you request will only be valid once accepted by our servers. Each valid bet/wager will receive a unique transaction code. We will not be liable for the settlement of any bets/wagers which are not issued with a unique transaction code. We reserve the right to adjust your account to reflect any incorrectly transferred monies relating to the incorrect settlement of bets. 42. Bets placed in accordance with our Betting Rules may only be amended or cancelled by mutual agreement. However, should a bet be accepted in error after the result of the race/event is known or after we have ceased to accept bets on the race/event concerned, the selection(s) involved will be void. 43. We reserve the right to refuse the whole or part of any bet. The right is also reserved to close an account without explanation, however, in such case, any bets already accepted and awaiting settlement will stand, unless made in contravention of our rules or otherwise fraudulently. 44. It’s a condition of our acceptance of bets from you and by placing a bet with us you represent that: You aren’t prohibited from entering into the bet by any term of your contract of employment or any rule of a Sports Governing Body which applies to you. You’re not aware of any circumstances which would make the placing of the bet a breach of a rule on betting applied by a Sports Governing Body. Where the bet is placed on the outcome of a race, competition or other event or process or on the likelihood of anything occurring or not occurring (“the event”) you don’t know the outcome of the event. In the event of such representation by you proving to be false your stake will be forfeited, and we shall not be obliged to pay any winnings which might otherwise have been payable in respect of the bet. 45. Where we reasonably believe that "match-fixing" has taken place, either as a result of the size or volume of bets received, or from other evidence (including where you are suspected of improper activity with any other online gambling website or services), or where the integrity of an individual event is called to question, we reserve the right to withdraw an offer, temporarily withhold payment and ultimately to declare bets on that event void. 46. Related contingency betting is not permitted. This is typically multiple bets which combine different selections within the same event are not accepted where the outcome of one affects, or is affected by, the other. For example, in a football match involving Chelsea and Manchester United: If Chelsea are 'evens (2.00)' to win at home to Manchester United and the correct score odds for Chelsea to win 1-0 is 8-1 (9.00), by having the double Chelsea to win and the correct score to be 1-0, a customer would be getting 17-1 (18.00) about an 8-1 (9.00) chance, for if Chelsea win 1-0 they would automatically have won the match. If such a bet is taken in error, it’ll be settled as two single bets with the stake equally divided. 45. Where selections dead-heat, the stake money is proportioned according to the number of selections which dead-heat and paid at full odds. 47. Outright markets (defined as after the draw/official field is confirmed for a specific event), may be subject to a deduction equivalent to Tattersalls Rule 4 (Deductions). Rule 4 will be applied, according to the table of deductions (a table of deductions, and further Rule 4 rules related to Horse Racing can be found within the Horse Racing section of Our Betting Rules); with the exception that a Rule 4 of 5 pence will not be enforced. Effectively Rule 4 will be applied in the case of participant withdrawals with odds of 9/1 (10.00) or smaller. Deductions may apply for any runners scratched from the Final Field prior to race commencement. Any such deductions will apply to the total payout value on all bets placed prior to the scratching and the reframing of a new market by us. 48. We won’t be liable for obvious/palpable errors. This includes bets where an obvious error is subsequently identified in the odds/handicap/totals/Cash Out amounts displayed or where we continue to accept bets or wagers on closed or suspended markets. This extends to settlement errors on bets or cash outs. In the event of an incorrect price being taken prior to the start of an event, any bets will stand and be settled at our revised price. If the revised price is deemed less than 1/1000 then bets will be void. Where there’s sufficient time before the start of an event, we’ll endeavour to contact you and may, in our absolute discretion, allow the option of cancelling the bet. When an incorrect player or team is quoted within a fixture all bets will be void at our discretion. If, for any reason, a pre-event bet is inadvertently accepted after a match or event has commenced, bets will be settled as follows: If the event and market is covered In-Play, then bets will stand at the revised price at the time the bet was placed (where a revised price is deemed less than 1/1000 then bets will be void) unless the outcome is already known, in which case such bets will be void. If the event or market is not covered In-Play then the bet will stand as long as the selected participant or team has not gained a material advantage (e.g. a score, sending off for the other team etc). Where a material advantage has been gained, we reserve the right to void the bet, win or lose. Any bet placed where the outcome is already known, including In-Play, will be made void. E) USE OF WEBSITE 49. Please read these Terms and Conditions, our Betting Rules and our Privacy Policy carefully and if you do not accept any part of them, don’t use the website. 50. Where you play any game, or place a bet or wager, using the website, you accept and agree to be bound by, the Rules which apply to the applicable products available on the website from time to time. The Rules can be found under our Betting Rules. 51. The current balance and transaction history of your account can be viewed at any time once you have logged into your account. 52. We actively monitor traffic to and from the website. We reserve the right, in our sole discretion, to block access where evidence suggests automated or robotic activity is taking place. 53. We may alter or amend the products offered via the website at any time and for any reason. 54. From time to time, all or part of the website may be unavailable for use by you due to website maintenance or alteration or amendment of any of the website products. 55. A link from our Website does not constitute an endorsement by us of the use of that link, the company or organisation behind that link or the contents of the website reached using that link. G) OUR LIABILITY 57. You shall indemnify and hold harmless BresBet, its subsidiaries, employees and agents and partners from any claims, liabilities, costs and expenses that may arise because of your breach of these terms and conditions or a breach of any laws of any jurisdiction applicable to you. In the event of such breach, your winnings may be forfeited, and we may retain any positive balance then existing on your account pending investigation and/or the conclusion of any legal proceedings. 58. Despite every effort to ensure complete accuracy, we cannot be held responsible for any errors in the information provided. In the event of incorrect odds being quoted, bets will be settled at the correct price. In such cases we will endeavour to contact the account holder, by writing to their registered email address, prior to the race/event, to offer the option of the bet being declared void. Should a response not be forthcoming within 72 hours, the bet will stand at the correct odds. 59. We shall not be held responsible for the accuracy of betting statistics, in-play data and editorial content whether supplied directly by us or via a third party. 60. You understand and acknowledge that, if there is a malfunction in a Game or its interoperability, any bets made during such malfunctioning shall be void. Funds obtained from a malfunctioning Game shall be considered void, as well as any subsequent game rounds with said funds, regardless of what Games are played using such funds. H) OUR INTELLECTUAL PROPERTY RIGHTS 61. Ownership of any intellectual property rights on the website including, without limitation, the software, images and text (the “IPR Rights”) remain with either BresBet or its licensors. The maximum real cash benefit that any customer will receive from any free bets on concessions is £2,000 per day. 63. We reserve the right to withdraw any promotional offer at our discretion and without prior warning. 64. Where any term of the offer or promotion is breached or there is any evidence of a series of bets/wagers placed by a customer or group of customers (e.g. where common betting patterns across the same fixture/markets have been identified across accounts), which due to a deposit bonus, enhanced payments, free and risk-free bets/wagers, or any other promotional offer results in guaranteed customer profits irrespective of the outcome, whether individually or as part of a group, we reserve the right to reclaim the bonus element of such offers and in our absolute discretion settle bets/wagers at the correct odds, void the free and risk-free bets/wagers or void any bet/wager funded by the deposit bonus. J) COMPLAINTS, DISPUTES, GOVERNING LAW AND JURISDICTIONS 68. We understand that there may be times when things go wrong, and that you’ll wish to have remedy for this. PLEASE NOTE - Whilst there are any active complaints, your account may be temporarily suspended for the duration of the procedure and until it is resolved. If any part of these T&Cs is deemed unlawful, void or for any reason unenforceable, then that part shall be deemed to be severable from the rest of these T&Cs and shall not affect the validity and enforceability of the remaining provisions of these T&Cs. 71. We accept no liability under the law in any jurisdiction other than the UK. All bets made with us, together with our T&Cs and Our Betting Rules, are governed by English law, and the courts of England and Wales shall have exclusive jurisdiction to settle any disputes that arise out of or in relation to them, provided that this choice of law will not prevent you from bringing proceedings in the courts of your home country, if different. K) IT FAILURES 74. We cannot be held responsible for a bet not being placed or an offer not being matched for any reason, or you being disconnected from the Website, including but not limited to computer malfunctions and failure of telecommunications services or internet connections. The balance of your account will at all times be as is recorded on our server. 75. The balance on the server when logging on to our Website, after you have been disconnected, will reflect the balance after completion of the last bet prior to the disconnection. We regret the imposition of the above, however, it is necessary to avoid further complications. By placing any further bets or offers on our Website, you accept the results of any previous bet. As such (at our discretion) the results of the previous bet are no longer in dispute and no refund or other adjustments will be granted.
